The purpose of these terms and conditions is to establish the terms under which ATELIER SALAMANCA sells Sicilian artisan creations (hereinafter "the Product/s") to its Customers (hereinafter "the Customer/s") through the Website www.ateliersalamanca.com (the "Website").

ATELIER SALAMANCA of Lerouge Stephanie is a sole proprietorship based in Via Magenta 58, 95030 Mascalucia (CT) in Italy. The intra-community VAT number is IT05784400870 and the email is info@ateliersalamanca.com (hereinafter "ATELIER SALAMANCA").

The acceptance of these terms and conditions ("T&C") implies full and unreserved acceptance by the Customer of these conditions.

All orders on the Website are subject to these conditions. These are subject to changes and updates; the conditions applicable to the order of a Product by a Customer are those in force on the day of the order.

 

1. SUBJECT

 

These T&C exclusively govern the sales made by ATELIER SALAMANCA of the Products offered to buyers having the status of consumers on the Website and specify the conditions of order, payment, delivery and management and any returns of products ordered by the Customers.

The T&C are opposable to the Customer who declares to have read and accepted them by checking the "I agree to the terms of service and will adhere to them unconditionally"box before executing the online ordering procedure.

 

2. CUSTOMER

 

The Customer of the Website must be a consumer, an adult and legally capable natural person. The Customer must fill in an order form specifying some mandatory fields so that his/her order for the Products can be taken into consideration by ATELIER SALAMANCA.

The information communicated to ATELIER SALAMANCA as part of each of its orders must be complete, accurate and up-to-date.

ATELIER SALAMANCA reserves the right not to process an order if the latter does not come from a Customer meeting the above criteria.

 

3. PRODUCTS

 

The essential characteristics of the Products are presented on the Website within each of the product sheets. In case of questions, the Customer can contact ATELIER SALAMANCA by e-mail at: info@ateliersalamanca.com.

 

4. ORDERING PROCESS

 

To order, the Customer need to follow the following steps:

the Customer visits the Website and adds the Product to his/her cart, specifying the quantity;

the Customer verifies the nature of the Products added to the cart;

to delete an article the Customer must click on "Delete" and to change the number of articles, change the quantity and it will automatically update;

the Customer can then finalize his/her order or choose to continue his/her purchases;

to conclude the purchase contract and finalize the order, the Customer fills in the order form and indicates the personal data required for the order;

the Customer must choose the delivery method;

the Customer must choose the payment method;

It is up to the Customer to check the details of the order and in particular the total price of his/her order, taking into account the price of the Products, the terms and costs of delivery, VAT, and the Product in particular in terms of quantity;

the Customer must read and accept the T&C;

The Customer proceeds with the payment.

Product prices are indicated on the Website in euros, including VAT, but excluding customs duties and other taxes.

Customs fees and other taxes must be paid by the Customer directly to the courier depending on the country of destination.

It is the Customer's responsibility to verify the accuracy of the information provided.

ATELIER SALAMANCA reserves the right to refuse, cancel and terminate orders at any time for legitimate and legal reasons.

ATELIER SALAMANCA will also have the right to refuse any order placed by a Customer with whom there is a dispute relating to the payment of a previous order as well as any order that does not comply with these T&C.

In these cases ATELIER SALAMANCA will inform the Customer by telephone or by e-mail.

In the event that the Products presented on the Site are no longer available or on sale at the time the order is sent, ATELIER SALAMANCA must promptly notify the Customer, and in any case, within thirty working days from the following day of the order, of the unavailability of the ordered Products. In case of payment of the price, ATELIER SALAMANCA will reimburse the Customer all the sums advanced for the unavailable Products.

Also, any order that only includes gift boxes cannot be sent and will be refunded.

The contract is concluded upon receipt by ATELIER SALAMANCA of the order after verification by ATELIER SALAMANCA of the accuracy of the data relating to the order.

 

After the order, an acknowledgment of receipt will be sent to the Customer by e-mail, containing a summary of the information relating to the order (essential characteristics of the product, price, method of payment, shipping cost).

 

5. PAYMENT

 

The Site offers payment by Credit Card or PayPal. When the order is finalized, ATELIER SALAMANCA confirms the payment by sending the Customer a summary email.

The prices displayed on the Website are expressed in euros, including taxes (Italian VAT and other taxes applicable on the day of the order). Packaging, order processing and shipping costs are indicated before order confirmation.

ATELIER SALAMANCA may change the prices of the Products at any time and without notice, in particular due to changes in the economic, legislative and fiscal framework. The Products are invoiced on the basis of the price in effect at the time of the order by the Customer.

The Products remain the full and entire property of ATELIER SALAMANCA until ATELIER SALAMANCA has fully received the payment of each order from the Customer.

Payment for purchases is made through the secure PayPal platform.

For delivery outside the European Union, the Customer must pay customs duties or other taxes due when importing the Products into the country of the place of delivery. The related formalities are also the sole responsibility of the Customer. The Customer is solely responsible for verifying the possibilities of importing the Products ordered with respect to the rights of the territory of the country of delivery.

 

6. DELIVERY

 

The Products are delivered to the delivery address indicated in the order form.

The package is delivered according to the shipping method offered by ATELIER SALAMANCA.

The Products are delivered all over the world. It is not possible to deliver to a hotel or PO Box address.

ATELIER SALAMANCA undertakes to ship all orders placed within the 24 hours following the order (only on working days). However, in periods of heavy traffic, ATELIER SALAMANCA reserves the right to extend the preparation of the shipping time to 72 hours.

What are the delivery times?

Shipping takes place on average within 3 working days for shipping to Italy.

For shipments abroad, delivery takes place on average within 4 working days for Europe, while for the rest of the world it takes on average 5 working days.

 

7. RECEIPT OF PRODUCTS

 

Upon receipt of the Product, the Customer is required to immediately check, in the presence of the courier, the condition of the packaging and of the Product delivered.

If, at the time of delivery, the packaging is damaged, torn or open, the Customer must therefore check the status of the Products contained therein. If these Products have been damaged, the Customer must absolutely refuse the package and note a reservation on the delivery note: damage, missing item, damaged package, broken item, etc. This check is considered carried out once the Customer accepts the package.

The Customer must therefore confirm his/her reservations to the carrier by sending out a letter at the latest within three days, excluding holidays, following the day of receipt of the Products and send a copy of this letter to ATELIER SALAMANCA.

Failure to comply with this deadline does not prevent the Customer from recourse to ATELIER SALAMANCA to obtain the reimbursement of the Products in the event of damage or anomaly of the Product at the time of its delivery. Likewise, the Customer always benefits from his/her right of withdrawal under the conditions set out in the following article 8.

 

8. RIGHT OF WITHDRAWAL

 

Following the rules for exercising the right of withdrawal pursuant to Legislative Decree n. 190 of 19 august 2005, art. 11, in the event of unsatisfaction with the purchased Product, the Customer can return the Product within 14 days of receiving the Product. By the fourteenth day, the Customer must inform ATELIER SALAMANCA of his/her return and refund request by sending an email with his/her order number to: info@ateliersalamanca.com

The Customer must send back the Product at his/her expense (except if the Product is not compliant) to the address communicated by the fourteenth day of receipt of the Product at the latest.

The Customer will have the possibility to choose the courier he/she wishes. We recommend that the Product is sent back with a service that provides the receipt and tracking of the package.

Upon verification that the Product received is as it has been sent out to the Customer in the same conditions, ATELIER SALAMANCA will have to refund the Customer within 60 days of the date of receipt of the package from ATELIER SALAMANCA according to the terms of PayPal.

The refund will be made to the same card used for the initial payment.

There is no possible exchange of the Product. If the Customer wants to make an exchange, he/she must first make a return and then buy again on the Website.

 

9. WARRANTIES ON PRODUCTS

The jewellery of ATELIER SALAMANCA is made with malleable metals and natural oxidation is not a manufacturing defect, but a natural consequence of use and is therefore not covered by warranty. Perfumes, air, salt water, creams, hairspray, sulfur, chlorine and Ph of the skin can accelerate wear times. ATELIER SALAMANCA also recommends that the Customer does not wear jewellery while bathing or during sports activities. For cleaning it is recommended to avoid aggressive chemicals and to use a soft cloth.

The dimensions, images and other characteristics of the Products may not be perfectly representative, but differ in color, size, accessories shown in the images. ATELIER SALAMANCA declines all responsibility for the possibility that the images and colors of the Products displayed on the Website may not correspond exactly due to a particular configuration of the computer or its malfunction. By sending the order, the Customer declares to fully accept the T&C and will pay for the Products ordered in the indicated way. ATELIER SALAMANCA reserves the right to make changes to the Products shown on the Website at any time without prior notice.

 

10. INTELLECTUAL PROPERTY

 

The Customer acknowledges that the ATELIER SALAMANCA Products and the distinctive signs (image, photographs and composition of photographs, concepts, packaging, Product names, texts, illustrations, etc.) are the exclusive property of ATELIER SALAMANCA.

12. APPLICABLE LAW AND COMPETENT JURISDICTION

 

The T&C are subject to Italian law.
